Florida FR-44 insurance

An FR-44 is a form an insurer files. The policy underneath still has to exist. If a letter from the court or FLHSMV says FR-44, use those words on the quote request.

General information, not legal or insurance advice.

A filing, with higher limits

Florida Statutes section 324.023 (2026) says an owner or operator who, regardless of adjudication, was found guilty or pleaded guilty or no contest to a DUI under section 316.193 after October 1, 2007 must be able to respond in damages of $100,000 for bodily injury or death of one person in one crash, $300,000 for two or more people in one crash, and $50,000 for property damage in one crash. Those higher limits must be carried for at least 3 years. Checked October 24, 2026.

The statute does not use the label FR-44. That name is the form.

FLHSMV, DUI frequently asked questions says that for a DUI after October 1, 2007 you obtain form FR-44 for those bodily-injury and property-damage amounts, or combined single limits of $350,000, and you keep the form for three years from the date your driving privilege is reinstated. The statute’s other path is a certificate of deposit of at least $350,000.

The DUI FAQ prints the first bodily-injury figure as "$100,00". The statute says $100,000. This page follows the statute.

Not the same thing as an SR-22

Florida Highway Safety and Motor Vehicles, Insurance Requirements describes an SR-22 as a filing certifying bodily injury and property damage liability for the Florida Financial Responsibility Law. FLHSMV, DUI frequently asked questions uses a different proof for a DUI on or before October 1, 2007: bodily injury of $10,000 per person, $20,000 per occurrence, and $10,000 property damage on the arrest date.

Read the letter you have. If it says SR-22, Florida SR-22 car insurance is the matching page. If it says FR-44, or the DUI conviction is after October 1, 2007, use this page. Florida DUI car insurance is the note about saying it on the first request.

PIP does not go away

FLHSMV, verification criteria for financial responsibility sanctions describes FR-44 proof for a DUI sanction as 100/300/50 bodily injury and property damage plus PIP, kept for 3 years. The check is about the person, not a VIN.

If a car is registered, the PIP and property damage floor is still the registration pair on the FLHSMV insurance page. The FR-44 limits are in addition to other financial responsibility the statute already required. They are not a replacement you invent.

If you do not own a car

Section 324.023 applies to an owner or an operator. It does not say you must have a vehicle titled in your name, and it does not name a non-owner policy. If there is no car to list, say that.

Read Non-owner car insurance in Florida. A provider has to say whether they can write a policy with no car on it and file the FR-44. This site will not promise that they can.

What to put on the request

  • FR-44, if that is the word on the letter.
  • The conviction year, if you know it, and whether it was after October 1, 2007.
  • Whether a car is titled to you.
  • Do not cancel a current policy to “start clean.” A lapse is part of the file.

Questions drivers ask

Is an FR-44 a kind of Florida car insurance?

It is a certificate an insurer files to show the higher liability limits in section 324.023. You still need a policy a carrier will write.

What are the FR-44 limits?

Section 324.023 requires $100,000 and $300,000 of bodily injury liability and $50,000 of property damage, for at least 3 years, after a DUI after October 1, 2007. FLHSMV’s DUI FAQ is where the form is named FR-44.

Do I need an FR-44 for a DUI from 2006?

The FLHSMV DUI FAQ uses the older $10,000 / $20,000 / $10,000 proof for a DUI on or before October 1, 2007. It uses the FR-44 for a DUI after that date. Repeat the words on your own letter.

Can I request a quote if I need an FR-44 and I have no car?

Yes. Say FR-44 and say that you do not own a car. Read the non-owner guide. A provider decides whether they can write it.

Request a quote and write FR-44 in the notes, plus whether a car is titled to you. The filing is not a policy by itself.
